| 摘 要： | 任何制度的设立都有其基本的价值取向。随着社会主体对生态利益的需求与日俱增,我国集体林权流转制度需要积极回应社会主体对生态的利益诉求,具有明显的生态化趋向。在生态视角下,从目标性价值、手段性价值和基础性价值三个层次来考虑,集体林权流转制度的价值应是包括生态和谐、生态效率和生态安全在内的一个完整的价值体系。为了实现这些法律价值,立法上需要通过赋予市场主体充分的森林资源经营权,完善集体林权流转配套制度等措施来进一步促进和规范集体林权流转行为。

| Abstract: | The establishment of any system has its basic value orientation.Along with the demand of ecological interest increasing,the Chinese collective forest rights transaction system needs to respond to the social subjects’ such demands and has obvious ecological tendency.From the view of ecology,the value of collective forest rights transaction system should be a completed system with the ecological harmony,ecological efficiency and ecological security included,with the consideration of targeted value,instrumental value and foundational value.In order to realize these legal values,we should promote and regulate the behaviors of collective forest rights transaction by making the subjects entitled with sufficient rights of forest resources management by legislation and perfecting many auxiliary system,etc. |
