| 摘 要： | 《关于争端解决规则与程序的谅解》(以下简称《谅解》或DSU)对执行程序规定了明确的时间界限,通过监督机制、补偿程序、报复程序,尤其是交叉报复程序加大了DSB裁决的执行力度。但DSU也有其缺陷:合理期间被恶意使用,执行监督程序规则过于简单,交叉报复对发展中国家欠公平。应建立集体报复制度、惩罚制度,完善执行监督程序,尤其是给予发展中国家的特殊待遇条款应具有可操作性。

On the implementation process of the WTO dispute settlement mechanism |

| Abstract: | 《Understanding on Rules and Procedures Governing the Settlement and Disputes》(hereinafter referred to as Understanding or DSU) stipulated explicitly on the time limits of implementation mechanism DSB rulings,and its supervision mechanism;compensation procedures;revenge program;especially the cross revenge has increasing the implementation force of the DSU rulings.However,implementation mechanism DSB rulings also revealed some shortcomings: Malicious use the reasonable period;the procedures of the supervision are too simple;the cross revenge is unfair for developing countries.So it is vital to establish the collective revenge systems;perfect the supervision of the implementation process;especially that the special terms of developing countries should be operable. |
