| 摘 要： | 流域整体性属性要求流域水环境管理的统一协调性。国家法律对此虽有所规定,但当前的流域水环境管理依然以行政区划为基础,此种分割管理的模式使得流域水环境管理难以实现统一协调,影响着流域水资源的可持续开发利用。如何协调流域水环境管理中地方政府间的关系,尤其是省际政府间的关系是关键。本研究从法律和机构两个层面分析了我国流域水环境管理中省际政府协调机制的现状,探讨了其在法律法规、机构和保障机制方面存在的问题,进而提出了3方面建议:建立与健全流域水环境管理的法律法规体系、构建流域水环境管理协调机构、建立与健全相关保障机制,以期对我国流域水环境有效管理提供指导。

| Abstract: | The attribute of integrity of a basin requires unification and harmonization in the management of water environment. Although relative regularities in China embodies this attribute, current management policies however, are based on administrative divisions, by which unification and harmonization of water environment can hardly achieved, resulting in unsustainable development of water resources. How to coordinate the relationship between local governments, especially between provincial governments, is a key issue for management of basin water environment. This paper summarized the provincial coordination mechanism in basin water environment management from two aspects: laws and institutions. Problems on laws and regulations, institutions and guarantee mechanism were pointed out. Suggestions were put forward from 3 aspects: to establish and improve the system of laws and regulations,to construct coordination institutions of basin water environment management,and to establish and improve guarantee mechanism in order to promote sustainable development of economy, society and environment. |
