| 摘 要： | 对数据库的保护是知识产权中的新课题，由于立法不可避免的滞后性，目前该领域的规范不尽完善。结合目前各国数据库法律保护的方式以及我国知识产权在此领域的发展，建立新的权利义务保护机制，更好地推动对数据库法律保护的发展与完善。

| Abstract: | To protect database is something new in intellectual property right protection. Owing to its inevitable lagging,the norm in this field in China is imperfect. Referring to the practices of database protection in various countries, this paper discusses the development of intellectual right protection in China and advocates the establishment of a new mechanism to define the rights and obligations so as to perfect the legal protection of database in China. |
