| 摘 要： | 构建社会主义和谐社会, 是我们党为完成执政历史任务、巩固执政社会基础、实现经济社会协调发展和国家长治久安而提出的重大理论和实践课题, 文章主要从法治的视角来系统论证构建和谐社会的必要性和可能性。首先, 从我国当前法治的制度现状、法治的功能以及中西国家治理的历史比较三个方面来分析法治对于构建和谐社会必要性的。其次, 法治对于构建和谐社会的可能性在于, 和谐社会与法治社会所追求的秩序井然、公平正义、权利保障等价值追求是一致的。

| Abstract: | Harmonious society is one of the most important tasks in theory and in practice, which can help to achieve historical goal of our party in reign, consolidating social base and promoting harmonious advance of society and long security. The paper reasons the necessity, possibility and roads of constructing harmonious society in view of ruling of law. The necessity results from such three aspects including the present system of law, function of law and lessons given by history of China and the West in managing the nation. The consistent ideals, such as good order, justice and safeguarding rights, are in line with the possibility of harmonious society. |
