| 摘 要： | 法律与道德,是一对相辅相成的概念.从法律的产生到法治的实现就是一个道德法律化和法律道德化交互演进的过程.道德与法律是社会规范最主要的两种存在形式,建立全新的德法并治的二元制法体制是创建和谐社会的前提和基础.
