| 摘 要： | 量刑均衡是刑法的追求目标,但法律作为一门社会科学,永远做不到自然科学的准确无误,由于各方面的原因,量刑失衡的问题日益严重。刑事法的研究逐渐从关注定罪向关注量刑发展,基于此,本文从了解我国的量刑现状入手,通过对量刑失衡问题原因的分析,主张在该领域借鉴欧美的先进制度,根据国情,解决我国的量刑失衡问题。

| Abstract: | Sentencing equilibrium is the goal of criminal law,but as a social science,law can not achieve accurateness.Imbalance sentencing is serious for many causes.The research of criminal law change gradually from emphasizing convict to sentence.Based on the current status of sentencing,this article analyses the cause of imbalance sentencing,according to reference the experience in western countries,put forward the system of sentence suitable for China. |
