| 摘 要： | 同一海产上有数个担保物权时，各类型权利间关系如何，各国立法规定不一，我国海商法第25条对此亦有所明文，但该条的简单化处理，其合理性与当事人利益保护的立法主旨，已有所不符，因此从比较法等角度对该问题作学理性的研究甚有必要。

| Abstract: | On the occasion that several security interests exist in one maritime property, with the arrangement of the relationship among them, different countries have different resolutions. China Maritime Law also prescribes it. In fact, though this clause is simple on solution, it seems unfit to the legislative intent and the protection of the parties interests. It is, therefore, necessary to discuss this problem from the perspective of comparative law and other aspects. |
