| 摘 要： | 农村宅基地产权制度改革是全面深化农业农村改革的主要内容和重点任务之一。行稳致远的农村宅基地产权制度改革客观上要求对当前各级政府正在推行的农村宅基地"三权分置"改革设计做进一步的理论思考和深入研究。当前农村宅基地"三权分置"改革设计有其创新性,但也存在一些不足和缺陷。农村宅基地产权制度改革目标取向及制度框架应是"两权分立、一户一宅、多元化配置",这既避免了与现代产权理论相冲突、相背离,又避免了"资格权"与现有法律不衔接、不相容,符合新发展理念,有利于促进公平和效率的有机统一。

| Abstract: | The reform of rural homestead property right system is one of the main contents and key tasks of comprehensively deepening agricultural and rural reform. As a progressive and far-reaching reform, it objectively requires an in-depth theoretical thinking and a careful study of "separating the three rights". The current reform design has its innovativeness, but also has some defects. The target orientation of the reform and its institutional framework should lie in:separation of the two rights, one homestead per household, and diversified configuration. In this way, it can avoid the conflicts with modern property right theory and the incompatibility of "qualification right" with existing laws, conforms to the new development concept, and promotes the organic unification of equity and efficiency. |
