| 摘 要： | 湿地,由于对人类、自然的特殊、重要之意义,其保护和合理利用问题越来越受到全球范围的普遍关注.多年来由于各种原因,我国湿地资源不合理利用,湿地污染比较严重,重大湿地污染事件的频发,湿地侵权损害赔偿问题日益突出,可以逐步建立湿地污染损害补偿基金制度、湿地民事惩罚性损害赔偿制度和湿地侵权责任保险制度等,形成完善的湿地损害赔偿法律制度,协调湿地法律和利益关系,保证我国湿地科学合理和可持续的利用. |

| Abstract: | Because the wetland has special and vital meaning for humanity and nature,its protection and rational utilization was more and more concerned by global scope of the universal.For many years,the wetland resources in our country have not been used rationally because of many reasons,which resulted in much serious pollution and many great accidents on wetlands.With the increasing of the wetland damage compensation,some legal systems of the wetland damage compensation,such as the fund system of damage compensation on wetland pollution,the system of punitive damages on the wetland,the insurance system of wetland infringement liabilities and so on,should be established step by step,and then some complete legal systems on the wetland damage compensation were constructed,in order to keep the coordination of wetlands legal and interest;ensure scientific and rational and sustainable use of wetlands in China. |
