| 摘 要： | 孙中山法治思想的理论基础是“权能分治”学说。在“权能分治”学说中“人民有权、政府有能”是“权能分治”的主要内容;“五权宪法”是“权能分治”的具体体现;“建国三时期”是“权能分治”的实施方案;三民主义是“权能分治”的指导思想。
