| 摘 要： | 土地承包经营权物权功能和效力的赢弱必然造成农地产权的不稳定,而这种不稳定性对农民以及中国的农业产生了不利的影响.反思了土地承包经营权的性质,阐述了稳定农地产权的两种主要理论路径,指出当下学界探讨的稳定农地产权的两种主要路径均存在较大的缺陷;提出了稳定农地产权的制度创新--农地持有权,并对农地持有权的内涵、基本性质及如何构建农地持有权进行了论述.农地持有权作为一种独立的权利形态,应该替代土地承包经营权而成为现实的选择.
