| 摘 要： | 社区矫正制度在中国已初步确立,但在司法实践中,广泛存在着将不同类型的社区服刑人员按照统一不变的模式塑造的统一管理方式。基于行刑个别化原则的理论及为更高质量地推进社区矫正工作考量,笔者建议更深入地研究社区矫正对象的分类及其不同的矫治对策,并提出城市、农村社区矫正对象的区分,成年、未成年矫正对象的区分,对累犯、假释犯等常见犯罪人类型提出一系列预防与矫治对策,并建议采用司法和社会工作相结合的方式。

| Abstract: | Community Corrections system has initially established in China,but in the judicial practice,widely exists the different type community serves a prison sentence the personnel according to the unification invariable pattern mold unification management way.Based on executes the individualizing principle the theory and rectifies the work consideration for the higher quality advancement community,the authors suggested more in-depth study of community correction object classification and different treatment measures,and make urban,rural community correction targets the distinction between adult and a minor correction of the distinction between objects,recidivism,parole,and other common crimes were committed by type of treatment and prevention of a series of measures and proposed to use the judicial and social work a combination.Hopes rectifies the system to the Chinese community the true establishment to have a benefit. |
