| 摘 要： | 随着世界范围内农业转基因生物的商业化应用,中国进口农业转基因生物的数量逐年增加。农业转基因生物的进口应依法进行,应从中国国内法的角度探讨农业转基因生物进口的法律规制。虽然中国已经初步建立规制农业转基因生物进口的法律体系,但是现行法律体系在立法效力层级、农业转基因生物标识制度、农业转基因生物追踪制度和法律责任等方面存在一定问题。因此,应从制定《转基因生物安全法》,增加农业转基因生物标识类型,建立农业转基因生物追踪制度,加大对违法行为的处罚力度等方面对农业转基因生物进口法律体系加以完善。

| Abstract: | With the commercialization of agricultural genetically modified organisms all over the world,the number of imported agricultural genetically modified organisms in China has been increasing in the past few years.The import of agricultural genetically modified organisms must be regulated by law;thus the legal regulation is discussed on the import of agricultural genetically modified organisms based on domestic law of China.Although China has established the legal system regulating the import of agricultural genetically modified organisms,there are defects about forms of law,labeling,tracking and responsibilities in the system.Thus,the legal system should be perfected through the following approaches:enacting Genetically Modified Organisms Safety Law,adding new type of label,establishing tracking rules and severe punishment. |
