| 摘 要： | 随着经济社会的发展,纠纷的形式日益多元化,单纯依靠诉讼来解决所有纠纷已不现实,构建多元化纠纷解决机制已经成为时代需要,ADR在构建多元化纠纷解决机制的过程中备受关注。目前,在我国,不是发展ADR以替代诉讼的纠纷解决方式,而是在法理之外,建立非诉讼的纠纷解决机制,明确ADR的法律效力,正确处理ADR诉讼的关系是前提。
