| 摘 要： | 2019年8月,A市动物卫生监督机构接到群众投诉举报,A市辖区有商贩涉嫌出售未经布鲁氏菌病、结核病检测的羊奶。经立案调查,认定行政相对人刘某违法事实清楚,证据确凿,按照《动物防疫法》及地方有关规定,依法给予了没收鲜羊奶,没收违法所得1020元,罚款3060元的行政处罚决定。本文对适格主体、违法事实、法律适用及违法所得认定等关键要素进行评析,对"一事不再罚"原则的适用,维护兽医公共卫生安全,强化部门联动,加强法律法规宣贯等内容进行了探讨,以期为类似案件的查处提供参考。

| Abstract: | In August 2019,a complaint was reported to the law enforcement officers of animal health supervision institution in city A,claiming that goat milk without testing for brucellosis and tuberculosis was sold in the municipal district.It was investigated and identified that the administrative counterpart had violated the law with conclusive evidences and been imposed a penalty of RMB 3060 yuan,and all fresh milk and illegal income of 1020 yuan were confiscated in accordance with Regulations on Animal Disease Prevention.In this paper,the key factors such as eligible subject,illegal facts,application of law and determination of illegal income were analyzed and commented.Meanwhile,application of the principle of"non-repeated punishment for one case",safeguard of veterinary public health safety,consolidation of joint law enforcement inspection as well as publicity and implementation of laws and regulations,were discussed,hoping to provide some references to investigate and handle with similar cases. |
