| 摘 要： | 我国现行海域使用管理制度中，关注重点主要是海域使用的平面性问题，忽视了海域资源布局的立体性，存在着很多交叉用海和重叠用海的冲突问题，造成海域资源配置的低效率，也导致海域资源产权的流失现象严重。文章从海域空间资源的产权入手，对海域空间三维多层产权界定的必要性和可行性进行研究，并将海域空间资源性资产的产权从立体三维角度界定为海域水面资源产权、海域水体资源产权、海域海床资源产权和海域底土资源产权四个部分，以期对海域空间资源的立体应用提供理论支持。

| Abstract: | The focus of our current sea area utilization is mainly the flatness question of sea area utilization, and ignores the solid layout of the sea resources. There are so many conflicts on sea area utilization, which leads to the low efficiency of sea resources allocation and the loss of the sea resources property. Based on the property of sea area resource, the paper researched the necessity and feasibility to define three-dimensional muhilayer property of sea area resource, and defined sea area resource property as four parts from the three-dimensional perspective. The four parts are sea floor resource property, sea water resource property, sea bed resources property and sea subsoil resource property. The paper also provides some theoretical support for three-dimensional utilization of sea area resources. |
