| 摘 要： | 解决矿业用地供给与需求之间的矛盾,关键是用地需求侧的改革。当前,矿业用地需求端有以"国家战略"为由确立"矿权优位"的趋势,矿产开发以"强制"连带"以及"优先"等方式获取集体土地,地权人有接受强制缔约的义务。"矿权优位"理论违反物权平等原则,不契合市场配置土地的改革目标。应以权利平等原则矫正"矿权优位"主义,让矿产权人与土地权人进行平等谈判、交易。矿业用地制度应坚持以"用"地为中心,以"用地"需求决定"获地"方式,而不是相反。以产权平等保护为原则,合理构建多元的矿业用地产权制度。

| Abstract: | The key to solving the contradiction between the supply and demand of mining land lies in the demand-side reforms. By sorting out relevant documents and investigation of mining land, it is found that "national strategy" is taken as "mining rights" on the mining land demand side; collective land is obtained for mineral development "compulsorily", "jointly" and "preferentially", and land owners have the obligation to accept compulsory contract. The theory of "superior mining rights" violates the principle of equal property rights and does not conform to the reform goal of market land allocation. The principle of "superior mining rights" should be corrected according to the principle of equal rights, and mineral owners should negotiate and trade with landowners on an equal footing. The mining land system should focus on the "use" of land and determine the "land acquisition" method according to the "land utilization" demand, rather than the other way around. Under the principle of equal protection of property rights, a reasonable and diversified system of mining land property rights should be constructed. |
