| 摘 要： | 通过2个典型案例分析,认为生态公益林建设的难点是成林之前幼林维护与周边村民资源利用之间的冲突,其根源在于幼林维护的权属不清。幼林维护权不仅依法确定,更需要得到利益相关者即周边村民的认可。为此提出建议,改变现行生态公益林建设政策,一是变政府投资造林为成林回购,二是把大中市郊荒山宜林地划分给市民绿化后用作墓地,并颁发相应的使用权证书。

| Abstract: | Through two typical case analyses, the article thinks the construction of ecological forest difficulty is conflict between young forest maintenance and the resource utilization of surrounding villagers, the key is young forest maintenance of ownership is not clear. Young forest maintenance right determined not only with the law, but also need validation from stakeholders who are surrounding villages. There are some suggestions, change the current policy on ecological public welfare forest construction： the first, changed from government investment in forestry to forest repo,the second, divided the large barren hills of outskirts which were green by citizens as a cemetery, and issued the ownership certificate. |
