| 摘 要： | 《濒危野生动植物种国际贸易公约》(Convention on International Trade in Endangered Species of Wild Fauna and Flora,以下简称CITES)是各国政府为确保野生动植物不致因国际贸易而受到生存威胁签署的一部多边国际条约。国家CITES管理体制的健全与否是CITES执行效力的关键。通过对中国内地和香港履行CITES的立法、履约物种名录、管理和履约机构、执法、许可证的审批程序等主要管理体系的比较分析,认为中国内地CITES管理体制中存在着立法和执法体系不够完善、多头管理、以及CITES允许进出口的证明书的审批程序繁杂等主要问题。这些问题,削弱了中国政府对野生动植物进出口管理的效率和水平。因此,中国内地需要尽快完善立法制度,加强执法体系建设,理顺行政机构职能,改进审批方式,简化工作程序,以促进履约和野生动植物进出口管理工作的持续科学发展。

| Abstract: | CITES(the Convention on International Trade in Endangered Species of Wild Fauna and Flora) is an international agreement between governments aiming to ensure that international trade in species of wild animals and plants does not threaten their survival.A perfect national management system is the key to CITES implementation.Based on a comparative analysis on legislation,endangered species list,function and structure of management authorities,enforcement system as well as the procedures of the permitting system between the Chinese Mainland and Hong Kong SAR,the paper states that several problems exist in the management system of CITES in the Chinese Mainland,such as the imperfect legislation and enforcement system,which is managed by various government agencies,and the lengthy and complicated permitting procedures,which impair the effective implementation of CITES in the Chinese Mainland.Accordingly,suggestions are put forward,including improving the legislation system,intensifying enforcement coordination,mainstreaming the functions and roles of the line management agencies,reforming the permitting measures and simplifying the management procedures,in order to promote the sustainable development of CITES implementation. |
